1. These terms
These terms apply to your use of this website. By using the site you accept them. If you do not accept them, please do not use the site. If you request a valuation or apply for membership, additional terms may apply to those services, and we will tell you at the time.
2. What EAN is, and what it is not
The Ethical Agent Network is a network of independent estate agencies that have met our membership criteria. We introduce consumers to member agencies and we provide information, guides and resources about buying, selling, letting and renting property.
We are not ourselves an estate agency, and we do not provide valuations, property advice, financial advice, legal advice or any other regulated service. When you request a valuation through this website, the valuation and any advice that follows are provided by the member agency that contacts you, not by EAN. Each member agency is an independent business, responsible for its own services, and any agreement you enter into is between you and that agency. We are not a party to it.
Membership of the network means an agency has met our criteria at the time of joining and remains subject to our standards. It is not a guarantee of any particular outcome, price or result, and it does not make us responsible for the services members provide.
3. Information on this website
The content on this site, including our guides and advice articles, is general information. It is not advice tailored to your circumstances, and you should not rely on it as a substitute for professional advice specific to your situation. We work hard to keep the site accurate and up to date, but we do not guarantee that every piece of content is complete, accurate or current at the moment you read it.
Review information shown on this site, such as member agencies' customer review scores, comes from public third-party platforms and reflects those platforms' data at the time we gathered it.
4. Valuation and introduction requests
When you submit a valuation or introduction request, you confirm that the information you give is accurate and that you are happy for us to pass it to one relevant member agency as described in our Privacy Policy. Submitting a request does not create any obligation on you to use the agency that contacts you, and no fee is charged to you by EAN for the introduction.
5. The member area
Parts of this site are reserved for members and require sign-in. Members are responsible for keeping their credentials confidential and for everything done under their account. Content in the member area is provided for members' own business use within the network and must not be shared outside it without our permission.
6. Intellectual property
The content of this website, including its text, design, graphics, logos and photographs, is owned by or licensed to The Ethical Agent Network Ltd and is protected by copyright and other intellectual property laws. You may view, download and print pages for your own personal use. You must not otherwise copy, reproduce, republish or commercially exploit any part of the site without our written permission. The EAN name and logo must not be used without our permission.
7. Acceptable use
You must not misuse this website. In particular, you must not: use it for any unlawful purpose; submit false or misleading information through our forms; attempt to gain unauthorised access to any part of the site, the member area, or the systems behind them; introduce viruses or other harmful material; scrape, harvest or bulk-extract content or data from the site; or use the site in a way that could damage it or impair anyone else's use of it. We may suspend or block access where these terms are breached.
8. Links to other websites
This site contains links to other websites, including member agencies' own sites and third-party platforms. Those sites are not under our control, we are not responsible for their content, and linking to them does not mean we endorse everything on them.
9. Availability and changes
We may update, change or remove content on this site at any time, and we may suspend or withdraw the site itself for operational reasons. We do not guarantee that the site will always be available or uninterrupted.
10. Our responsibility to you
Nothing in these terms excludes or limits our liability where it would be unlawful to do so. That includes liability for death or personal injury caused by our negligence, and for fraud.
Subject to that: if you are a consumer, we are responsible for foreseeable loss or damage caused by our breach of these terms or our failure to use reasonable care and skill, but we are not responsible for loss that was not foreseeable, and we are not liable for business losses. If you use the site in the course of business, we exclude, to the fullest extent permitted by law, all implied conditions and warranties, and we are not liable for loss of profit, business, goodwill or data, or for any indirect or consequential loss arising from your use of the site.
Because the services you may receive after an introduction are provided by independent member agencies, we are not liable for the acts or omissions of any member agency.
11. Governing law
These terms, our Privacy Policy and our Cookie Policy are governed by the law of England and Wales. Any dispute is subject to the jurisdiction of the courts of England and Wales, except that if you are a consumer living in Scotland or Northern Ireland you may also bring proceedings where you live, and nothing in these terms affects your statutory rights as a consumer.
